Terms of Service

These Terms of Service govern access to and use of Streetwise Software websites, digital products, creative services, software tools, online media projects, downloads, submissions, and related services.

1. Agreement to These Terms

By accessing or using any Streetwise Software website, product, file, tool, page, download, form, payment page, submission system, or service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use our websites or services.

When you submit content to Streetwise Software, including music, lyrics, images, artwork, photos, logos, business information, advertisements, bios, links, text, files, metadata, or project materials, you represent and warrant that:

You grant Streetwise Software a non-exclusive, worldwide, royalty-free license to host, store, reproduce, modify for formatting or technical operation, display, publish, stream, distribute, promote, and otherwise use submitted content as needed to provide the requested services, operate the applicable website or project, complete your order, and display approved public content.

You keep ownership of your submitted content unless a separate written agreement states otherwise.

7. Artist, Music, Media, and Advertising Submissions

For music, artist, advertising, or media submission services, approval is not guaranteed. We may reject, remove, disable, edit for formatting, or decline to publish submissions that are incomplete, technically unusable, legally questionable, unsafe, misleading, low quality, abusive, or inconsistent with the project’s standards.

You are solely responsible for rights clearance, ownership, licensing, publishing rights, performance rights, samples, beats, vocals, artwork, images, advertisements, trademarks, and any third-party material included in your submission.

Unless a separate written agreement says otherwise, publication on a Streetwise Software project does not transfer ownership to Streetwise Software and does not guarantee payment, placement, traffic, streams, sales, approvals, rankings, reviews, or results.

8. Purchases, Payments, and Refunds

Prices, payment options, product details, service descriptions, and availability may change at any time unless already confirmed in writing for a specific paid order.

9. Project Work, Client Review, and Approval

For custom website, software, design, media, or creative work, clients are responsible for reviewing drafts, proofs, test builds, public pages, forms, payment links, contact information, spelling, prices, policies, product details, and all submitted materials before approval or launch.

Once work is approved, published, delivered, downloaded, or installed, additional changes may require additional fees unless included in a separate written agreement.

10. Streetwise Software Intellectual Property

Streetwise Software websites, designs, layouts, interfaces, code, templates, graphics, logos, text, processes, documentation, software tools, branding, and other materials are owned by Streetwise Software or its licensors unless otherwise stated in writing.

You may not copy, sell, duplicate, redistribute, claim ownership of, reverse engineer, remove branding from, or reuse Streetwise Software materials outside the scope of your approved project, license, or written permission.

11. Copyright Complaints

If you believe content on a Streetwise Software website infringes your copyright or other intellectual property rights, contact us through the official contact method listed on the applicable website and include enough information for us to identify the content and review the claim.

We may remove, disable, or restrict content that appears to violate rights or these Terms. We may also request additional verification before taking action.

Our websites and projects may use or link to third-party services, including hosting providers, payment processors, analytics tools, music platforms, social media platforms, embedded media, advertisers, customer websites, email providers, file storage providers, and security tools.

We are not responsible for third-party websites, terms, privacy policies, availability, security, pricing, content, payment decisions, account actions, or platform changes.

We may update, modify, pause, replace, restrict, remove, or discontinue any website, feature, service, product, file, download, submission system, or public page at any time. We do not guarantee uninterrupted access, error-free operation, permanent hosting, permanent storage, search ranking, traffic, sales, streams, downloads, approvals, or compatibility with every browser, device, platform, plugin, server, or third-party service.

Streetwise Software services are provided “as is” and “as available” unless a separate written agreement states otherwise. To the fullest extent allowed by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free performance, and guaranteed results.

We do not guarantee that websites, tools, media players, payment links, downloads, forms, third-party integrations, hosting environments, browser behavior, or platform features will remain available or unchanged.

15. Limitation of Liability

To the fullest extent allowed by law, Streetwise Software will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost files, business interruption, reputational harm, lost opportunities, platform issues, third-party actions, or unauthorized access beyond our reasonable control.

To the fullest extent allowed by law, our total liability for any claim related to a paid service will not exceed the amount you paid to Streetwise Software for the specific service giving rise to the claim during the three months before the claim arose.

You agree to defend, indemnify, and hold harmless Streetwise Software from and against claims, damages, liabilities, losses, costs, and expenses arising from your use of our services, your content, your submissions, your breach of these Terms, your violation of law, your payment disputes, or your infringement of any third-party rights.

17. Termination and Removal

We may suspend or terminate access, remove content, disable downloads, block IP addresses, reject submissions, revoke admin access, or stop providing services if we believe you violated these Terms, created security risk, caused payment issues, submitted unlawful or infringing content, abused a service, or created risk for Streetwise Software, users, customers, or third parties.

18. Governing Law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules, unless applicable law requires otherwise.

19. Changes to These Terms

We may update these Terms from time to time. When we update them, we will change the “Last Updated” date above. Continued use of our websites or services after updated Terms are posted means you accept the updated Terms to the extent allowed by law.
